Terms of Service
These Terms govern your purchase of goods from DATA (“DATA”, “we”, “us”), operated by Island Global Company at data.ec. By placing an order you agree to these Terms. If you do not agree, do not place an order.
1. Made-to-measure goods
Every DATA garment is made to measure and produced to order from measurements derived from your submitted photographs and stated height. Each piece is unique to one body, cut and sewn specifically for you, and is not held in stock. Because each garment is personalised and made to your specification, it is a bespoke, final-sale good (see Returns & Final Sale below).
2. Orders & acceptance
Your payment is an offer to purchase. We may accept or decline any order at our discretion, including where an item is unavailable, where measurements cannot be produced reliably, or where we suspect fraud. If we decline, we will refund the amount paid. A contract forms only when we confirm your order and begin production.
3. Measurements & fit
You are responsible for following the scan instructions accurately and for the accuracy of the height and photographs you provide. DATA computes measurements from what you submit and our atelier verifies them before cutting. Because the garment is cut to your provided data, fit variance resulting from inaccurate or non-conforming submissions is not a defect and is not eligible for remedy.
4. Pricing, currency, taxes & duties
Prices are shown in US dollars and are exclusive of any import duties, customs fees, or destination taxes. As the importer of record, you are responsible for any duties or taxes levied by your destination country. We are not responsible for delays or charges imposed by customs authorities.
5. Payment
Payments are processed by Stripe. We do not receive or store your full card details. By completing checkout you authorise the charge and confirm you are the authorised holder of the payment method.
6. Production & shipping
Production timelines are estimates and begin once your measurements are confirmed. Shipping is worldwide via tracked courier. Title and risk pass to you on delivery to the carrier. Estimated timelines are not guarantees, and we are not liable for carrier or customs delays.
7. Warranty for defects
We warrant that garments will be free from manufacturing defects and will materially conform to the design ordered. If a garment arrives with a genuine manufacturing defect or differs materially from the order because of our error, your remedy is set out under Returns & Final Sale.
8. Intellectual property
All content on this site — imagery, text, designs, the DATA name and marks — is owned by DATA or its licensors and may not be copied or reused without written permission.
9. Limitation of liability
To the fullest extent permitted by law, DATA’s total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential losses. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Governing law
These Terms are governed by the laws of [jurisdiction — to be confirmed], and disputes are subject to the exclusive jurisdiction of its courts, without prejudice to any mandatory consumer protections available to you where you live.
11. Changes
We may update these Terms; the version in effect at the time of your order applies to that order.
Returns & Final Sale
Every DATA garment is made to measure and cut to a single body. Because each piece is produced uniquely to your specification, it cannot be resold or restocked, and is sold as a final-sale, bespoke good.
By placing an order you acknowledge and agree that:
- Your garment is custom-made to your measurements and is therefore not eligible for return, exchange, or refund on the basis of change of mind, fit preference, or size.
- Where the law grants a statutory cancellation or “cooling-off” right for distance sales, made-to-measure and personalised goods are typically exempt from that right, and you agree that production may begin before any such period would otherwise expire.
The only exceptions
If your garment arrives with a genuine manufacturing defect, or differs materially from what you ordered due to our error, we will — at our discretion — remake the garment or refund it. To claim, contact atelier@data.ec within 14 days of delivery with your order number and clear photographs. This does not cover fit outcomes arising from the measurements or photographs you submitted, ordinary wear, or damage after delivery.
Changes & cancellations
Because production begins quickly, orders can only be changed or cancelled before cutting begins. Once your measurements are confirmed and production has started, the order cannot be cancelled. To request a change, email atelier@data.ec immediately after ordering.
Nothing in this policy affects rights you have under mandatory consumer law that cannot be waived.
Privacy Policy
This policy explains what personal data DATA collects, why, and your rights over it.
What we collect
- Order & contact details — name, email, shipping address, and phone number, collected to fulfil and communicate about your order.
- Measurement data — the body measurements derived from your scan, plus the height you enter.
- Payment — handled entirely by Stripe. We receive confirmation and limited details (such as the last four digits and billing country); we never receive or store your full card number.
Your photographs stay on your device
The scan runs in your browser. Your photographs are processed on your device to compute measurements and are not uploaded or stored by DATA. Only the resulting measurements are transmitted with your order.
Who processes your data
We use a small number of trusted processors to run the service: Stripe (payments), Resend (order emails), and Vercel (site hosting). Each processes data only to provide their service. We do not sell your personal data, and we do not run advertising or third-party tracking on this site.
Cookies & storage
We use only your browser’s local storage to remember your cart between visits. We do not use advertising or analytics cookies.
Retention & security
We keep order and measurement data for as long as needed to fulfil your order and meet legal, tax, and accounting obligations, then delete or anonymise it. We apply reasonable technical and organisational measures to protect it.
International transfers
We ship worldwide, so your data may be processed in countries other than your own, including by our processors above. Where required, we rely on appropriate safeguards for such transfers.
Your rights
Depending on where you live, you may have the right to access, correct, delete, or restrict the use of your personal data, or to object to certain processing. To exercise any right, email atelier@data.ec and we will respond within the time required by applicable law.
